国际计划（中国）雅安市教育基金会向四川芦山地震灾区提供紧急物资援助备忘录

Agreement on Providing Relief Materials to Earthquake area in Sichuan Lushan between Plan China and Yaan City Education Foundation

   

国际计划和雅安市教育基金会有着共同的工作目标和关注人群。为了对在四川芦山地震灾区受灾害影响的儿童提供紧急物资援助, 国际计划（中国）（以下简称甲方）与雅安市教育基金会（以下简称乙方）通过协商，就援助物资事宜达成如下一致：

Plan China and Yaan City Education Foundation have same goal and target group. In order to provide relief material support to children suffering from the earthquake in Yaan Lushan, through discussion between Plan China (hereafter referred as Party A) and Yaan City Education Foundation (hereafter referred as Party B), the two parties reached the following agreement: 

I. 援助地点 Supporting Location

雅安市雨城区Yucheng Distric, in Yaan City

II. 合作名称 Name of Cooperation

向四川芦山地震灾区受灾家庭和儿童提供紧急物资援助Providing relief materials to the children and families in Sichuan Lushan area.

III. 合作方式 Ways of Cooperation

    为了使援助物资尽快送到雅安市地震灾区，改善灾区儿童的生活状况，经过双方多次积极地友好协商，就以下问题达成共识：In order to deliver relief materials to the disaster areas earlier, so as to improving living conditions of children, two parties have agreed:

1. 甲方提供紧急援助物资，具体物资明细见附件一。Party A  provide the goods specified as the Appendix 1 of this document.

2.  双方就援助物资的清单进行了讨论并达成一致。Two parties have discussed and reached agreements on the supply list.

3. 乙方在援助物资到达后负责接收，并负责分发该援助物资至受地震影响的儿童（特别是女童）。Party B will accept the emergency goods when it is arrived, and take the responsibility to distribute them to the children (especially girls) in the disaster affected location.

4. 甲方在雅安市负责完成物资交接手续。Party A hands over materials to party B officially in Yaan City.

IV. 甲、乙方权利义务 Rights and Responsibilities of Party A and Party B.

1．甲方权利和义务Rights and Responsibilities of Party A：

1）甲方义务Responsibilities of Party A

  • 甲方保证及时组织所援助物资并运往雅安市雨城区；Party A shall organize all the goods procurement and transport to the location of Yaan Yucheng district.

  • 遵守当地法律，尊重当地文化传统和生活习惯 Observe the local law and respect the local culture and living habit.

2）甲方权利Rights of Party A

  • 知晓援助物资分发的过程和结果、受益人群的分布和数量。Get information regarding relief material distribution and results. The distribution of benefit children and numbers.

  • 从乙方得到受益者关于物资接受情况的确认。Could get confirmation from the people who receive the materials through Party B.

  • 在适当的时候对所援助的灾区进行回访并采集受益人群相关图片和文字材料。Visit the disaster areas at the proper time and collect information such as photos and other materials.

 

2．乙方权利和义务Rights and Responsibilities of Party B：

1）乙方义务Responsibilities of Party B

·        负责接收甲方援助物资并负责分发到双方约定的受灾学校。具体学校见附件二Accept the emergency materials when it is arrived, and distribute to the target group in the disaster affected location as agreed upon. Attached 2 are the detailed schools for distribution of goods.

  • 协助甲方人员在灾害后期进行的信息收集和审计审评，并根据甲方要求向甲方提供详细和真实的支持材料。Facilitate Party A’s staff in the evaluation and auditing, and also provide detailed and true supporting document upon request of party A.  

  • 向甲方提供援助物资发放完结报告,包括现场照片，物资在灾区的发放时间、区域（如学校或街道名称）接受人接受记录和受益人群信息。Provide Party A the final distribution report, including pictures, record of the distribution and reception, the distribution time, location( such as names of schools or streets) and beneficial population. 

2）乙方权利Rights of Party A

  • 在符合本协议规定的情况下，有权拒绝甲方的其它要求。When requirement specified in this agreement is met, Party B has the right to reject other unreasonable requirement by Party A.

V. 违约责任及争议处理方式Responsibilities for breaching this agreement and dispute resolution.

未经双方书面同意，任何单方面的与本协议不一致的做法均视为无效。不良后果由当事方承担。Without written agreement by both parties, actions not in line with this agreement taken by either party is invalid. The party which takes the action will be held responsible for any negative result caused.
